Govt sanctions prosecution of JKLF leader Noor Kalwal for anti-India activities

The authorities have sanctioned the prosecution of JKFL leader, Noor Mohammad Kalwal, for his involvement in the anti-India activities in 2018.

In a notification issued here recently it has been noted that on 1 December 2018, a tip-off was received by Police Station, Sherghari, that on 30 November 2018, outside the Dastigeer Shahib Shrine, Sariebala, one person namely Noor Mohammad Kalwal S/o Gh. Rasool Kalwal R/o Malbagh, Soura, affiliated with
JKLF organization, after Friday prayers “raised pro-freedom and anti national slogans, besides instigated people for cessation of erstwhile J&K State from the country.”

Subsequently a case FIR No. 68/2018 under Section 13 of ULA (P) Act, was registered in the Police Station,
Sherghari and the investigation of the case was set into motion. During the investigation, Noor Mohammad Kalwal was arrested in the case and it was established that “on 30-11-2018, the accused after Friday prayers raised pro-freedom and anti national slogans thereby instigated the general public against the integrity and sovereignty of the Union of India.” The prosecution order further reads that on the basis of investigation, and other evidence collected, the Investigating Officer has established, prima facie,
involvement of the accused in the case punishable under the Unlawful Activities (Prevention)
Act, 1967.

“Whereas, the Authority, appointed by the Government under Sub-Section (2) of Section 45 of the Unlawful Activities (Prevention) Act, 1967, has independently examined the Case Diary File and all the
other relevant documents relating to the case and has come to the conclusion that a prima facie case is made out and after perusing the Case Diary File, the relevant documents and also taking into consideration the views of the Authority appointed under Sub-Section (2) of Section 45 of the Unlawful Activities (Prevention) Act, 1967, the Government is of the view that there is sufficient material and evidence available for prosecution under the provisions of law. Now, therefore, in exercise of the powers conferred by subsection (2) of Section 45 of the Unlawful Activities (Prevention) Act, 1967, the Government hereby accord sanction for launching prosecution against the accused viz. Noor Mohammad Kalwal for the commission of offence punishable under Section 13 of ULA(P) Act, arising out of FIR No. 68/2018 of Police Station, Sherghari,” reads an order issued by the Home department.
